The terms of service for consultation on a tour in Kenya serve as a contractual agreement between the visitor and the operator/consultant. They set the expectations, protect the rights of both parties and ensure a mutually beneficial consulting relationship. These terms encompass various aspects of the consultation, including the consultant's expertise, the consultation fees and payment details, the duration of the services, and the limitations of liability. Consultation Scope: The services provided by the tour operator/consultant are limited to offering guidance, advice, and recommendations regarding tours in Kenya, which include travel arrangements, facilities bookings, or related services only where such services have been explicitly agreed upon in writing and cited in the detailed service agreement and/or shared invoice.

Service Fees and Payments: Service fees and payments for travel arrangements, bookings, and reservations are based on the individual needs of each client. A booking or reservation will only be confirmed upon receipt of the required payment, which serves as acceptance of the targeted or temporary reservations made for flights, hotel facilities, transportation, and other services. 

All payment amounts are subject to variations that may arise between the time of quoting and the time of payment, including but not limited to changes in supplier rates, taxes, fuel surcharges, currency fluctuations, or availability of services. In such cases, the client will be informed of any adjustments necessary to secure the final confirmed booking.

Amendments and Cancellations: If the client wishes to amend or cancel any travel arrangements, flights, bookings, or reservations of hotels, facilities, or consultation services, they must notify our tour company in writing as soon as possible and before final bookings and reservations are confirmed. In such cases, the company reserves the right to charge a cancellation fee. 

If cancellation or amendment requests are received after payments have been made to the respective suppliers (including airlines, hotels, national parks, conference organizers, exhibition organizers, transport providers, and accommodation facilities), the applicable cancellation policies and penalties of those suppliers will apply in full. The company shall not be liable for any losses, fees, or non-refundable amounts imposed by the suppliers.

Forfeited Prepaid Services: The company shall not be held liable for any forfeited or unused prepaid services resulting from the client’s own actions, omissions, or circumstances beyond the company’s control. Such instances include, but are not limited to:

    • Missed or delayed flights.
    • Abandoned or unused portions of prepaid itineraries.
    • Cancellation or denial of facility use due to illegal activities, misconduct, or violations of local laws and regulations.
    • Oversights or failures on the part of the client, such as failure to obtain required travel documents or failure to adhere to scheduled times.

In all such cases, any payments made for these services will be considered non-refundable, and the company bears no responsibility for reimbursement or compensation.

Changes to Itinerary: The tourist understands that the tour or trip itinerary provided during the consultation is subject to change based on various factors, including but not limited to weather conditions, unforeseen circumstances, or recommendations from local authorities. The visitor must be informed about any significant changes to the itinerary so that they can agree to be flexible and adapt to these changes.

Travel Insurance: Most tourists acknowledge the importance of obtaining comprehensive travel insurance that covers medical expenses, trip cancellation or interruption, baggage loss, and other potential risks associated with the tour in Kenya. It is strongly recommended that the tourist purchases suitable travel insurance and cannot be held responsible for any losses or expenses incurred due to the traveler's failure to obtain adequate insurance coverage.

Flights and Travel Bookings: Flight bookings are strictly subject to the terms, conditions, and cancellation policies of the respective airlines and flight agencies. The consultant acts solely as an intermediary in facilitating such bookings where agreed. Any cancellations, rescheduling, or refunds for flights will be handled according to the airline’s or agency’s policies, and the consultant shall not be liable for losses arising therefrom.
